IPONZ conducts formal and substantive examinations of designs. IPONZ automatically starts the substantive examination within 15 days of receiving the design application, no need for the applicant to submit a specific request separately, the applicant has 12 months (can be extended up to 3 months) to overcome the defect to meet the grant conditions, IPONZ only examines Novelty of exterior design. Designs can only be transferred to others after they have been granted a patent.

• Grant fee: The applicant should pay the granted fee, registration fee and first annual fee within 4 months after receiving the granted decision.

Reinstatement of priority is accepted on grounds of "due care."

The novelty of an invention will not be affected if it is disclosed within 12 months before its patent application date or priority date:

• disclosed by the inventor;
• Disclosed by the Patent Application Accepting Authority,
• and that information is included in:
  • In other applications of the inventor, and disclose the application when the relevant authority should not disclose the application;
  • In applications submitted by third parties who have obtained information directly or indirectly from the inventor without the inventor's permission;
• Disclosure of the invention by a third party who has obtained information, directly or indirectly, from the inventor.

Examination of form only. The utility model application is examined for compliance with formal requirements, uniformity and registrability. If there is no special requirement, no novelty review will be conducted. The applicant can submit a request for delay in grant within 2 months from the filing date/priority date, and the grant can be delayed for 15 months at the latest.
