The JPO conducts formality examination and substantive examination of invention patent applications. The applicant should submit a request for substantive examination within 3 years from the filing date. The JPO makes an granted decision if it determines after review that no grounds for refusal have been found.

• Grant fee: The applicant should pay the granted fee, registration fee and first annual fee within 4 months after receiving the granted decision.
• Annuity: pay year by year from the 3rd year from the application date, the annual fee can be paid within a grace period of 6 months if the annual fee is overdue, and the penalty is 50% of the annual fee of the year.

20 years

The BPO only conducts formality examination of utility model patent applications. The formality examination takes 3 months, and the content of the examination includes whether the applied for utility model patent application belongs to the object of protection, the issue of unity, etc. If the granted conditions are met, the patent is authorized.

The design does not lose novelty if it is exhibited at an officially recognized international exhibition within 6 months of the filing/priority date, or if it is disclosed as a result of apparent misuse by the applicant or its previous owner.

INPI only conducts formality examination of utility model patent applications. Substantive examination may only be requested if the applicant deems it necessary. An invention protected by a patent can be protected simultaneously or successively with a utility model. To this end, applicants have a maximum of 1 year to make changes.

Acceptance of restoration of priority on grounds of "due care" and "unintentional/due care"

• Licensing Fee: None.
• Annuity: From the 5th year onwards from the date of application, it will be paid year by year. The application fee includes annual fees for the first and second years. There is no annual fee for the third and fourth years, but the applicant needs to notify INPI for renewal in the third and fourth years. All subsequent annual fees must be paid within six months before the date corresponding to the year of application. Overdue annual fees can be paid within a 6-month grace period, and 50% of the annual fee of the current year is required to be paid as a penalty.

The BPO conducts formality examination of design patent applications.

IPOPHIL conducts formality examination and substantive examination for invention patent applications. After completing the formality examination and prior art search, the applicant needs to enter the public procedure within 18 months from the filing date/priority date, and enter the substantive examination procedure if there is no objection. The applicant shall submit a request for substantive examination within 6 months from the date of publication of the application or within 6 months from the date of entering the national phase at the latest. If the requirements are met, the patent application will be authorized.

3-4 years

The novelty grace period is 6 months before the filing date/priority date.
